• I've been served with a restraining order, what does this mean?

Answer:

Retraining orders come in various forms and have different terms and durations. In the Orange County criminal law system, restraining orders are issued in virtually all domestic violence cases. Often, protective orders are issued even over the victim's objection. Just because the protected party does not want the order does not mean you can violate it. Violating these orders can result in immediate arrest and incarceration so you should obey all terms of the order even if it means you cannot even speak to the protected parties for long periods of time. These orders are often issued illegally as defendants are entitled to a hearing before protective orders of significant duration are issued. In the case of domestic violence protective orders, it is vital that an attorney appear with you at your arraignment to object to the order and set a hearing to contest the ad hoc issuance of criminal restraining orders.
